Terms of Use

These terms are the agreement between your driving school and Moga Web for the use of MELT Tracker. By creating an account, uploading records, or paying an invoice, your school accepts them.

1. What MELT Tracker is

MELT Tracker is record-keeping software. It takes the schedule your school already maintains, validates it, and generates ICBC MV7605 and MV7604 forms from it, keeping a searchable history of what was uploaded and when.

Two limits worth being clear about

We are not affiliated with ICBC. MELT Tracker is an independent product. It is not endorsed, certified or approved by the Insurance Corporation of British Columbia, and “ICBC”, “MV7605” and “MV7604” are referred to only to describe what the software produces.

Compliance remains yours. The software checks the data you give it, but it cannot know whether that data is true. Your school stays responsible for the accuracy of its records, for meeting ICBC’s Class 1 MELT requirements, and for anything it submits to a regulator. Nothing we provide is legal or compliance advice.

All amounts are in Canadian dollars and exclude tax, which is added to every invoice.

4. What “unlimited support” means

Support is unlimited in volume — there is no ticket cap, no hourly billing, and no fair-use throttle on how often you ask. It is bounded in scope: it covers making the software you already have work correctly for you.

Support is delivered by email at support@meltforms.com, Monday to Friday, 10 AM to 2 PM Eastern Time. We aim to respond within 48 hours. If a request turns out to fall outside the included scope, we will tell you before doing any chargeable work — you will never receive a surprise invoice for support.

6. Acceptable use

You agree not to: resell or sublicense the service to another school; attempt to access another school’s records; probe, scan or interfere with the security of the service; upload malware; reverse-engineer the software; or use it to create or store records you know to be false.

7. Availability

We work to keep MELT Tracker available and will give advance notice of planned maintenance where we reasonably can. We do not promise uninterrupted or error-free service, and we are not responsible for outages caused by third parties such as hosting providers, networks or your own equipment. Keep your own copies of the schedules you upload — do not rely on MELT Tracker as your only record.

8. Warranties and liability

The service is provided “as is”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the extent the law allows, our total liability arising from these terms or the service is limited to the fees your school paid us in the twelve months before the claim arose. We are not liable for indirect or consequential loss, lost profits, lost business, or for regulatory penalties, audit findings or enforcement action arising from records your school submitted. Nothing here limits liability that cannot be limited by law.

9. Indemnity

You agree to indemnify us against claims arising from your school’s use of the service in breach of these terms, or from records you uploaded without the right to do so.

11. Changes to these terms

We may update these terms. For material changes we will give account holders at least 30 days notice by email. Continuing to use the service after a change takes effect means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction, and both parties submit to them.
